SMS Communications Consent

1. Company Overview
Guardian Visibility LLC is a cold chain monitoring company based in Kalispell, Montana. We provide real-time temperature and location tracking for refrigerated freight using IoT devices installed in carrier trailers.
SMS messaging is used exclusively for:
- Internal operational alerts to company administrators (system status, server health, critical infrastructure notifications)
- Carrier equipment notifications (device status, installation confirmations, temperature alerts for monitored loads)
SMS is NOT used for marketing, promotional content, or unsolicited communications.
2. Consent Collection Methods
2.1 Verbal Consent (Primary Method for Internal Staff)
For internal operational alerts sent to Guardian Visibility staff and administrators, verbal consent is obtained directly from each recipient. The company CEO and operations staff have provided explicit verbal authorization to receive system health alerts, server status notifications, and critical infrastructure messages at their designated mobile numbers.
2.2 Verbal Consent Script (Carrier Onboarding)
The following script is used by Guardian Visibility representatives during carrier onboarding phone calls to collect verbal consent for SMS communications:
GV Representative:
"As part of the Guardian Visibility Carrier Preferred Program, we offer SMS notifications to keep you informed about your equipment and monitored loads. These include temperature alerts, device status updates, and important account notifications. Message frequency varies based on your account activity — typically just a few messages per month. Standard message and data rates from your carrier may apply. You can opt out at any time by replying STOP to any message, or by contacting us at support@guardianviz.com or (406) 430-6100. Would you like to receive these SMS notifications at your mobile number?"
[If carrier agrees]
GV Representative:
"Great, thank you. Can you please confirm the mobile number you would like us to use for SMS notifications? And just to confirm — you understand that you can reply STOP at any time to opt out?"
[After carrier confirms number and understanding]
GV Representative:
"Perfect. I have you confirmed for SMS notifications at [phone number]. I am noting your verbal consent in our system along with today's date. You will receive a confirmation message shortly. Again, you can opt out anytime by replying STOP. Thank you for enrolling in the program!"
[If carrier declines]
GV Representative:
"No problem at all. You can always opt in later through your Carrier Portal settings or by contacting us. We will continue to reach you via email for important notifications."
2.3 Written Consent (Carrier Agreement)
Carriers also provide written consent by electronically signing the Carrier Preferred Program Agreement, which includes Section 13: SMS Communications Consent. This section explicitly covers message types, frequency, opt-out procedures, and privacy protections. The signed agreement is accessible at:

3. How Consent is Recorded and Stored
3.1 Data Recorded
When consent is collected (verbal or written), the following information is recorded in our system:

3.2 Storage and Retention
All consent records are stored in Guardian Visibility's Oracle Cloud database with full audit trails. Records include timestamps, the method of consent, the representative involved, and the specific phone number(s) authorized.
Consent records are retained for the duration of the carrier relationship plus three (3) years after termination, in accordance with our data retention policy.
4. Opt-Out Instructions
Recipients may opt out of SMS communications at any time using any of the following methods:
- Reply STOP: Text STOP to any message received from Guardian Visibility. A confirmation message will be sent and no further SMS will be delivered.
- Email: Send opt-out request to support@guardianviz.com
- Phone: Call (406) 430-6100 during business hours
- Carrier Portal: Update communication preferences in account settings at https://guardianviz.com/portal
After opting out, the recipient will receive a single confirmation message and no further SMS communications. Opting out of SMS does not affect email notifications or other account communications. Users may opt back in at any time using any of the consent methods described above.
5. Opt-In Confirmation Message
After consent is recorded, the recipient receives the following confirmation SMS:
"Guardian Visibility: You're enrolled in SMS alerts. Reply STOP to unsubscribe. Msg freq varies. Std msg & data rates may apply. Help: support@guardianviz.com"
6. Privacy and Data Protection
- Guardian Visibility does not sell, rent, or share phone numbers or SMS consent data with third parties for marketing purposes.
